Case summary
On July 7, 201, Region 5 entered into an Expedited Settlement Agreement (ESA) and Final Order with NOVA Chemicals, of Painesville, Ohio, commencing and concluding a matter under the Resource Conservation and Recovery Act (RCRA) for a settlement amount of $1,000. EPA alleged that NOVA Chemicals had failed to : either cease storing hazardous waste on-site for more than 90 days or to obtain a permit for such storage pursuant to RCRA and the EPA approved Ohio hazardous waste program. Prior to entering into the ESA agreement, NOVA Chemicals, demonstrated to EPA that it was in compliance with RCRA and its implementing regulations.
