(Textron Aviation) under the Resource Conservation and Recovery Act (RCRA). EPA alleged that the company violated RCRA by: (1) storing a container in a less-than-90-day storage area for greater than 90 days; (2) using a hangar pit as a hazardous waste tank without first obtaining a Professional Engineer certification; (3) failing to mark nine containers with accumulation start dates; (4) failing to label two containers with the words ?Hazardous Waste?; (5) failing to minimize unplanned releases; (6) failing to maintain training records; and (7) failing to list all emergency equipment in the facility?s contingency plan. Textron Aviation thereby allegedly violated 40 C.F.R. Part 270 and Section 3005 of RCRA, 42 U.S.C. ? 6925(a), by failing to meet all conditions for an exemption from a RCRA permit. To settle this matter, the company has agreed to pay a $20,175 penalty and implement a Supplemental Environmental Project (SEP). The SEP consists of a HEPA vacuum sanding system for sanding aircraft that will capture paint chips and dust at the point of generation. The total SEP cost is estimated to be $49,782.
