Case summary

On January 10, 2017, U.S. EPA Region 5 filed a Consent Agreement and Final Order (CAFO) that simultaneously commences and concludes an administrative action with the Regal Finishing Company (RFC) of Coloma, Michigan. RFC provides custom-finished coatings and painting for product components in a wide variety of industries. The CAFO alleges that RFC violated the Resource Conservation and Recovery Act (RCRA), as determined during an inspection on January 21, 2016. During the inspection, it was found that 1) RFC had stored hazardous waste on site for greater than 90 days without a license or interim status, 2) RFC failed to provide the necessary information in its hazardous waste contingency plan, 3) RFC failed to maintain records related to its biennial waste reporting, and 4) that RFC had failed to properly manage and label containers of universal waste. RFC has agreed to pay a $25,922 civil penalty to resolve the alleged violations and has demonstrated that it is now in compliance with all applicable RCRA regulations.
