Case summary

The Minnesota SERC referred this facility to CEPPS for investigation of potential EPCRA Section 312 violations. This facility submitted a Tier II report on February 16, 2015 for the calendar year 2014, and has not filed a Tier II since. Tier IIs are due on March 1 for the previous calendar year. In calendar year 2014 they had present 145,000 pounds of propane. Propane has a 10,000 pound threshold. The MN SERC has made written and verbal attempts to bring this facility into compliance to no avail. An Information Request was sent by EPA to this facility on August 16, 2016. A response was never received, but they did submit a Tier II to the MN SERC on September 27, 2016. Based on this submission, Consumers Coop was storing 145,000 pounds of propane. They sell the propane to their own members and to members of the public. Propane has a 10,000 pound threshold for reporting. EPA and Consumers Coop agreed to an ESA with a civil penalty of $5,000.
