Case summary

EPA entered into an Administrative Consent Order (ACO) with Integrity Biofuels, LLC. (Integrity), Morristown, Indiana to address violations regarding the Standards of Performance for New Stationary Sources (NSPS) for Equipment Leaks of Volatile Organic Compounds (VOC) in the Synthetic Organic Chemicals Manufacturing Industry (SOCMI) at Subpart VVa and the NSPS for VOC Emissions from SOCMI Distillation Operations at Subpart NNN. Integrity violated NSPS Subpart NNN rules by failing to prove that it complied with one of the three alternative emissions reduction requirements, failing to comply with the monitoring of emissions and operations, and failing to comply with the performance testing requirements that apply to each distillation unit and reactor process. Lastly, Integrity failed to implement the LDAR requirements specified in NSPS Subpart VVa. This ACO requires Integrity to implement and maintain an LDAR program according to the requirements set forth in 40 C.F.R ?? 60.480a through 60.489a and to improve emissions monitoring by installing devices to measure the temperature and flow rate of water entering the scrubber (final emissions control device). This ACO addresses the violations set forth in the FOV issued to Integrity on June 27, 2016 and is being filed concurrently with a Consent Agreement and Final Order requiring Integrity to pay a penalty of $24,130 over twelve months.
