Case summary
Welsch allegedly violated the fugitive particulate matter emissions requirements of 35 Ill. Admin. Code Part 212, Subpart K of the Illinois State Implementation Plan (SIP) at its facility located at 2330 South Morgan Street, in the Pilsen neighborhood of Chicago, Illinois. On August 14, 2013 and July 18, 2014, in response to complaints, EPA inspected the facility and observed that Welsch did not have a fugitive particulate matter operating program and was failing to water or clean its traffic areas on a regular basis, in violation of the SIP. Along with this CAFO, EPA is issuing an Administrative Consent Order requiring Welsch to update and utilize its fugitive particulate matter operating program for the Chicago facility. This CAFO requires Welsch to pay a penalty of $20,000.00 and to complete a Supplemental Environmental Project consisting of a water sprinkler system on its aggregate piles. This settlement resolves the May 23, 2014 Notice of Violation issued to Welsch.
