Case summary

EPA and SEG have reached an agreement in principle to resolve violations of the Ozone Depleting Substances (refrigerants) provisions of the CAA. Some final language is still being drafted. SEG agreed to: ? Implement a Refrigerant Compliance Management Plan; ? Reduce its company-wide average leak rate from 22.2% to 17.0% over 3 years; ? Retrofit or replace 33 refrigeration appliances; ? Ensure that any new grocery store uses only Advanced Refrigerant; and ? Pay a civil penalty of $300,000. The Consent Decree affects 574 Southeastern Grocers stores that operate under the banner names Winn Dixie, Harveys, Bi-Lo, and Fresco Y Mas.
