EPA v. ASSOCIATES ENGRAVING COMPANY

Case summary

Associates Engraving Company (AE) was a manufacturer of award plaques, trophies, and donor displays, employing approximately 45 workers at a facility located at 2601 Colt Road, Springfield, Illinois. AE no longer operates the business, having sold it to an unrelated company in June, 2015. AEs production processes generated solvent and solvent-based paint hazardous wastes (D001 and F005), and chromium wastes (F006). AE allegedly violated the Resource Conservation and Recovery Act (RCRA) by: (1) failing to mark two containers of hazardous waste with accumulation start dates in violation of 40 C.F.R. 262.34(a)(2); (2) failing to label the same two containers with the words Hazardous Waste in violation of 40 C.F.R. 262.34(a)(3); (3) storing hazardous waste in a less-than-90-day storage area for greater than 90 days in violation of 40 C.F.R. 262.34(b); and (4) failing to provide hazardous waste training for employees as required by 40 C.F.R. 265.16(a). AE thereby violated 40 C.F.R. Part 270 and Section 3005 of RCRA, 42 U.S.C. 6925(a), by failing to meet all conditions for an exemption from a RCRA permit. AE will pay $25,524 to resolve the alleged violations. The facility is currently in compliance with RCRA under its current ownership.
