Case summary
Respondent failed to submit to the SERC an MSDS for lead by March 31, 2013, a violation of Section 311 of EPCRA. Respondent failed to submit an MSDS for lead to the LEPC by March 31, 2013. Respondent failed to submit to the Green Oak Township Fire Department an MSDS for lead by March 31, 2013.As of July 23, 2015, Respondent had not submitted to the SERC, LEPC and the Green Oak Fire Department, a completed Emergency and Hazardous Chemical Inventory Form including lead for CY 2012. As of July 23, 2015, Respondent had not submitted to the SERC, LEPC and the Green Oak Township Fire Department a completed Emergency and Hazardous Chemical Inventory Form for CY 2012, and other counts as outlined in this CAFO, violations of Section 312 of EPCRA. The civil penalty agreed to to settle this action was $43,524 for the EPCRA violations.
