Case summary
Respondent submitted to the Michigan SERC, the Wayne County LEPC and the Taylor Fire Department a completed Emergency and Hazardous Chemical Inventory including ferrous chloride, hydrochloric acid, and sodium carbonate on July 22, 2015 for calendar year 2012; on July 22, 2015 for calendar year 2014; and on May 14, 2015 for calendar year 2014. USEPA and Respondent agreed to a CAFO dated March 22, 2016, with a civil penalty of $12,948 for these EPCRA violations. Respondent also agreed to perform a supplemental environmental project (SEP) designed to protect the environment or public health by installing a backup fan on the Facility's scrubber system. Respondent must spend at least $78,860 to install the equipment - a second fan on the scrubber system with gates to switch between fans in the event of the failure of one of the fans. Respondent must submit a SEP completion report to USEPA by January 31, 2017, as outlined in the CAFO.
