Case summary
On June 3, 2015, Respondent released approximately 4,710 gallons of soybean oil from the facility. The oil flowed from a pump at the facility, travelled overland, and discharged to the waters of the Grand River and its adjoining shorelines. The oil caused a film or sheen upon or discoloration of the surface of the Grand River and its adjoining shorelines. This discharge of oil on June 3 is a violation of Section 311(b)(3) of the Clean Water Act. The civil penalty agreed to by USEPA and Respondent was $45,000.
