Case summary
On July 7, 2015, an EPA representative conducted a compliance inspection of the Respondent, located in Minnoka, IL, to determine its compliance with the RMP regulations promulgated under 112(r) of the Clean Air Act and determined that Respondent had violated the following: 1. failed to maintain records on the off-site consequence analysis that includes for the worst-case scenario; 2. failed to maintain records on the offsite consequence analysis that includes the alternative case scenario; 3. failed to maintain records on the offsite consequence analysis that included documentation of estimated quantity released, release rate and duration of release; 4. failed to maintain records on the offsite consequence analysis including data used to estimate population and environmental receptors potentially affected; 5. failed to compile and maintain up-to-date safety information related to regulated substances, processes and equipment; 6. failed to ensure that each employee presently operating a process, and each employee newly assigned have ben trained or tested competent in the operating procedures; 7. failed to train or cause to be trained each employee involved in maintaining the ongoing mechanical integrity of the process; 8. failed to perform inspections and tests on process equipment. This action was settled with an ESA, with a penalty of $2,880.00.
