On January 24, 2015, a release of 3,259 pounds of sulfuric acid occurred from Respondent's facility between 11:00 am and 3:00 pm. On February 27, 2015, between 2:10 pm and 4:10 pm, a release of 44.22 pounds of benzene was released from Respondent's facility. Respondent did not immediately notify the NRC of either release, a violation of Section 103(a) of CERCLA. EPA and Respondent agreed to settle the matter with a CAFO with a civil penalty of $11,518.00, due within 30 days after the effective date of this CAFO.
