Case summary
Andersons owns and operates a fuel grade ethanol production dry mill facility at 3389 West County Road 300 South, Logansport, Indiana (the facility). On September 29, 2014, EPA issued a Notice of Violation and Finding of Violation to Andersons. EPA alleged that the November 2011, and June 2012 stack test results demonstrated that at wet scrubber S-40, the facility emitted acetaldehyde in excess of the permitted limit of 1.05 lbs/hr and total HAP emissions in excess of the permitted limit of 1.20 lbs/hr. The June 4, 2012 stack test results demonstrated that at wet scrubber S-40, the facility emitted VOC emissions in excess of the permitted limit of 9.42 lbs/hr.The May 15, 2013 stack test results demonstrated that at baghouse #1, the facility emitted PM10 and PM2.50 in excess of 1.00 lb/hr. The May 14, 2013 stack test results demonstrated that at baghouse #2, the facility emitted PM10 and PM2.50 in excess of 0.86 lb/hr as required by Title V Permit No. 017-32589-00023. EPA has issued the Administrative Penalty Order concurrently with the CAFO on this matter. Andersons' subsequent compliance stack tests demonstrated compliance with the Title V permit emission limits. Andersons will pay a penalty of $99,100.
