EPA v. ADELMANS RESOURCE SOLUTIONS - ACO
Case summary
U.S. EPA Region 5 issued an Administrative Consent Order (ACO) to Adelman's Truck and Equipment Corp. d/b/a Adelman's Resource Solutions (Adelman's) to resolve violations of the Clean Air Act (CAA). EPA alleged that Adelman's accepted for motor vehicle air conditioners that contained or once contained ozone-depleting refrigerants, without either recovering the refrigerant from the appliances or verifying that the refrigerant had been properly recovered prior to sale to Adelman's, in violation of regulations found at 40 CFR 82.156 and that Adelman's knowingly vented or otherwise released into the environment refrigerant or substitute from motor vehicle air conditioners in violation of 40 CFR 82.154(a)(1). EPA issued a Finding of Violation to Adelman's on April 11, 2014. The ACO requires Adelman's to use previously obtained refrigerant recovery equipment and to properly recover the refrigerant from appliances and motor vehicles it accepts use verification statements or refrigerant recovery contracts. Since the refrigerants used in motor vehicle air conditioners are also potent global-warming gases, these resolutions will, in addition to protecting the ozone layer, have the added benefit of reducing the emissions of greenhouse gases.
