Case summary
Cardinal operates an ethanol manufacturing plant in Union City, Indiana. On June 13, 2012, EPA performed an unannounced inspection of the facility. EPA observed that volatile organic compounds (VOC) emissions and the overall VOC control efficiency demonstration was not performed on the enclosed flare that controls VOC from the ethanol loading rack. EPA verbally indicated that the facility to perform the testing to determine the overall VOC control efficiency at the flare. Based on the Section 114 Response, Cardinal did not perform the required VOC control efficiency testing on its flare. EPA is issuing the Administrative Penalty Order concurrently with the CAFO on this matter. Cardinal's subsequent compliance stack tests demonstrated compliance with the Title V permit emission limits. Cardinal will pay a penalty of $29,743.
