EPA v. Rosebud Mining Company Mclain Mine

Case summary

On September 20, 2010, Rosebud Mining Company, while exploring the site to determine its suitability for mining, cleared shrubs, tree litter, small trees and soil to level a path for a drill, using a D-7 bulldozer. The clearing resulted in the placement of fill material in approximately 20 linear feet of Stream #1 and 30 linear feet of Stream #2. The Rosebud Mining Company also placed a culvert in Stream #1 using a rubber-tired backhoe. Under the AOC, Rosebud Mining Company will restore the two streams by removing any fill placed in them, and will submit a Restoration Plan. Upon EPA?s approval of the Restoration Plan, Rosebud Mining Company will implement the Restoration Plan within four months of EPA?s approval of the plan.
