In August of 2014, Respondent was a general contractor and added 4,520 cubic yards of sand or dirt or fill material from bulldozers and backhoes into 1.22 acres of wetlands to build a baseball diamond at Aquatore Park, in Blaine, Minnesota, without a U.S. Army Corps of Engineers Section 404(b) Dredge and Fill Permit, 33 U.S.C. ? 1344, and in violation of section 301 of the Act, 33 U.S.C. ? 1311. The CAFO required Respondent to comply with the Act and to pay a civil penalty of $2,500.00.
