Case summary

On June 12, 2009, an RMP was submitted by the Respondent. On March 11, 2012, a correction to the RMP was submitted to change, among other things, the name of the owner to Siemens Healthcare Diagnostics Inc - Mishawaka. On September 11, 2014, EPA sent a Request for Information Pursuant to Section 114(a) of the Clean Air Act to Respondent to determine its compliance with the RMP regulations promulgated pursuant to Section 112(r) of the Act. EPA determined that Respondent violated 40 CFR 68.190(b)(1), the requirement to resubmit its RMP five years from the last submission. A settlement of $2,000 was agreed upon.
