Case summary

Section 312 of EPCRA requires owner or operator of a facility to prepare and submit to the State Emergency Response Commission (SERC), Local Emergency Planning Committee (LEPC) and fire department with jurisdiction over the facility annually an emergency and hazardous chemical inventory form (Tier I or Tier II) covering all hazardous chemicals present at the facility. Ammonium Nitrate Liquor, Prilled Ammonium Nitrate, Dyno Gold Bulk Emulsion, Dyno Gold Bulk Emulsion Explosive # 1062, Severely Hydrotreated Light Napthenic Distillate, Titan Fuel Phase Emulsifying Fuel Mixture, Diesel No. 2-D, Sodium nitrate HQ Free Flowing, Dyno Cord Sensitive Boosters. Ethylene glycol, ANFO, Q-cell Inorganic Microspheres, liquefied petroleum gas or propane, Low Sulfur Diese, lUrea, Titan RU Uphole Fuel Phase, Emulsifying Fuel mixture, Blastek Packaged Emulsion Explosive, sulfuric acid for calendar year 2012and calendar year 2013. Respondent submitted a revised Tier II for calendar year 2012 on September 17, 2014 and for calendar year 2012. Each day Respondent failed to submit in a timely fashion constitutes a separate violation of EPCRA Section 312. Respondent agreed to a civil penalty of $42,614 for non-timely submission of said inventories.
