Case summary

On April 26, 2012 an authorized EPA representative conducted a compliance inspection of the Aeropres Corporation, Manhattan, Illinois facility to determine its compliance with the Risk Management Program (RMP) regulations promulgated pursuant to Section 112(r) of the Clean Air Act. Based on that inspection EPA determined that Respondent violated the following regulations: 1. 40 CFR 68.25(a)(2)(iii) failure to analyze the storage of liquefied petroleum gases on the railroad tracks; 2. 40CFR 68.69(a)(1)(iv) failure to develop written emergency shutdown procedures;3. 40 CFR 68.69 (a)(2)(I) - failure to address the consequences of deviation in the operating procedures; 4.40CFR 68.69(a)(2)(ii) failure to address the steps required to avoid or correct deviation; 5. 40CFR 68.71(b) failure to provide refresher training on the operating procedures; and 6. 40 CFR 68.160(b)(7) -failure to include in its risk management plan the maximum quantity of each regulated substance in the process. The penalty was $6,080.00.
