Case summary
On April 24, 2015, USEPA Region 5 signed a Consent Agreement and Final Order simultaneously commencing and concluding an action against Spartan Motors, Inc. of Charlotte, Michigan for alleged violations of the Emergency Planning and Community Right-to-Know Act (EPCRA). Region 5 alleged that Spartan Motors failed to submit MSDSs to the SERC, LEPC and the local fire department for the following hazardous chemicals present above threshold: diesel fuel, sulfuric acid, and lead in lead-acid batteries, ethylene glycol and gasoline. Spartan had never submitted Tier II chemical reporting forms under Sections 311 and 312 of EPCRA to the SERC, LEPC, or the local fire departments. The violations have now been corrected at all of its facilities. Spartan agreed to pay a civil penalty of $50,000.00 to the U.S. Treasury within 30 days. Spartan also requested to perform a Supplemental Environmental Project (SEP), which will consist of an environmental management audit system valued at $74,328.00, to be completed as outlined in this CAFO.
