Case summary
Scepter Inc. (the Respondent) is a secondary aluminum recycling and trading company. It is headquartered in Waverly, Tennessee and has five additional locations in the U.S. and Canada. An inspection was conducted at this facility on November 19, 2013. The facility had present four hazardous substances above the reporting threshold. The Respondent had properly reported ammonia and diesel fuel in previous years. However, Scepter failed to submit a Material Safety Data Sheet to the SERC, LEPC, and fire department for potassium chloride and hydraulic oil, and failed to submit Tier II reports to the SERC, LEPC and fire department for calendar years 2010-2012. A Notice of Intent to file a Civil Administrative Complaint was issued on July 28, 2014. EPA originally calculated a $79,410.00 proposed penalty. The penalty was reduced 25% for cooperation and 10% for settling before the Complaint was filed. Scepter, the Respondent, has agreed to accept the terms of this CAFO and pay a civil penalty of $51,617 to the U.S. Treasury within 30 days after the effective date of this CAFO.
