Case summary

On June 26, 2012, an authorized EPA representative conducted a compliance inspection of the Preferred Freezer Services of Chicago,LLC, Chicago, Illinois refrigerated warehouse (Facility) to determine its compliance with the Risk Management Program (RMP) regulationspromulgated pursuant to Section 112(r) of the Act, and set forth at 40 C.F.R. Part 68. Based on the July 25, 2012 inspection, EPA has determined that Respondent violated the following regulations: 1. 69(c)Respondent failed to review and certify annually that the operating procedure are current and accurate. 2. 73(b)Respondent failed to extablish written procedures to maintain the on-going integrity of the refrigeration system. 3. 87(b)Respondent failed to obtain and evaluate contractor's safety performance and programs. 4. 195(a)Respondent failed to timely submit the data required under 68.168,170(j) and 175(l) with respect to an accidental release that occured on November 21, 2009.
