Case summary

The Consent Agreement and Final Order (CAFO) for Gavilon Grain, LLC resolves violations regarding the Illinois State Implementation Plan (SIP) at its two facilities in Alexis and Abingdon, Illinois; and for Gavilon Global Ag Holdings, LLC to resolve violations regarding the Illinois SIP at its facility in Joliet, Illinois. The three Gavilon facilities failed to follow the Illinois SIP regulations applicable to grain elevators and their permits by failing to: (1) keep facility grounds and surfaces clean; (2) adequately asphalt, oil or treat the yard and driveway to control dust; (3) conduct required inspections of the grain elevator equipment; (4) use socks or sleeves that extend six inches below the sides of vehicles during loading; and (5) maintain housekeeping records. As part of the settlement, Gavilon will install a second baghouse at the Joliet Facility to control the unloading of feed ingredients at the dump pits and to control loading at the intermodal container load-out. Gavilon is also paying a penalty of $268,000. A penalty of $89,333.33 is attributable to each of the three facilities.
