Case summary

The Stipulated Settlement and Final Consent Order (Stipulated Order) will resolve claims by the United States against S.H. Bell Company (SHB) for opacity and fugitive dust violations and failure to comply with a monitoring request issued under Section 114 of the Clean Air Act (CAA), 42 U.S.C. ? 7414. The Stipulated Order requires injunctive relief and payment of a civil penalty in the amount of $100,000. SHB agreed to shall install four continuous PM10 monitors and one PM10 filter based monitor no later than March 1, 2017. SHB also agreed to submit a proposed monitoring site plan within 30 days of the date of the order and operate its existing meteorological station for the monitoring period consistent with the 114 Request. Finally SHB agreed to operate the monitors for a period that allows 12 months of data collection and to utilize and/or install, as appropriate, the dust control measures, plans, or programs.
