Case summary

This Consent Agreement and Final Order (CAFO) for Atlas Resin Proppants, LLC (Atlas), in Merrillan, Wisconsin, will resolve violations of Atlas's Synthetic Minor Non-Part 70 Operation Permit. Specifically, Atlas conducted stack testing on November 6, 2013, for formaldehyde, phenol, and total VOCs pursuant to EPA's Clean Air Act Section 114 request. Atlas failed to meet its phenol limit on Tower F, one of its four resin-coated sand processing lines. Atlas?s phenol limit is 0.43 lb/hr; the stack test showed 1.01 lb/hr. Atlas has since performed corrective actions on its exhaust and drainage system for Tower F, and retested phenol emissions from the unit on February 13, 2014. That follow-up stack test showed compliance with Atlas's permitted phenol limit. No other corrective actions are determined to be necessary to ensure Atlas?s continued current and future compliance with its phenol limit. The CAFO requires Atlas to pay a penalty of $8,500 and spend $40,000 on a supplemental environmental project (SEP) at the Merrillan School District. The SEP provides for the replacement of outdated temperature controls on the HVAC systems at a local elementary school, resulting in significantly increased energy efficiency, improved indoor air quality, and reduced environmental asthma triggers and allergens.
