An inspection was done by USEPA Region V of the Tasty Breads International facility in Franklin Park, IL, pursuant to an inspection by USEPA on December 7, 2011, an Information Request from USEPA on July 16, 2013, and a follow-up Information Request by USEPA on September 4, 2013. On July 7, 2014, USEPA entered into a fully executed Consent Agreement and Final Order (CAFO)with Tasty Breads, with a penalty of $10,000.00 for violation of CERCLA due to a release of anhydrous ammonia on September 1, 2011, and a penalty of $115,000.00 for violation of EPCRA Sections 311/312 for failure to submit an MSDS for anhydrous ammonia to the SERC and LEPC and the Franklin Park Fire Dept., a completed emergency and hazardous chemical inventory form, failure to notify NRC of the release immediately, nor was the SERC or LEPC notified. In addition the Respondent failed to provide the written follow-up emergency notice to the LEPC in timely fashion.
