EPA v. Dominick's Finer Foods, Inc. (Northlake) Enforcement Action ESA

Case summary

On July 18, 2011, an authorized USEPA representative conducted a compliance inspection of the Dominick's Finer Foods, Inc. Northlake, Illinois refrigerated warehouse to determine its compliance with Section 112(r)(7) of the Clean Air Act. Based on that inspection, USEPA determined that Dominick's had violated the following regulations: (1) failed to document the persons responsible for implementing individual requirements of the risk management program and define the lines of authority through an organization chart or similar document; (2) failed to compile documentation pertaining to the relief system ddesign and design basis; and (3) failed to developa written schedule of when the recommendations of the process hazard analysis were to be completed. USEPA and Dominick's entered into an Expedited Settlement Agreement (ESA) on June 18, 2014, with a total civil penalty of $810.00.
