Case summary
Marathon owns and operates a liquefied petroleum gas storage facility located at 24400 Allen Road, Woodhaven, Michigan. On March 21, 2011 authorized representatives of USEPA conducted an inspection at the Woodhaven Facility to determine its compliance with 40 C.F.R. Part 68, as part of a CAA RMP 112(r)(7)inspection. Based on that inspection and a review of additional information, USEPA identified the following violations of the Risk Management Program Regulations: Failure to report in the RMP additional worst-case release scenarios for a hazard class; failure to have process safety information contain the relief system design and design basis; failure to establish a system to promptly address the team's findings and recommendations; failure to certify annually that its operating procedures are current and accurate and have been reviewed; failure to ensure that the frequency of inspections and test of process equipment is consistent with applicable manufacturers' recommendations, good engineering practices and prior operating experience; failure to document each inspection and test that had been performed on its process equipment; failure to correct deficiencies in equipment that was outside accceptable limits defined by the process safety information before further use; failure to initiate incident investigations not later than 48 hours following the incident; and failure to include the date the incident investigation began its report. Based on an analysis of factors in Section 113(e) of the Act, USEPA determined a civil penalty of $23,200 should be paid, and was paid. In addition, respondent has already contributed $87,000 to the Woodhaven Fire Department, as a supplemental environmental project (SEP) designed to protect the environment and public health, which said Fire Department has used solely for the purchase of fire and emergency repsonse equipment, including the purchase of 19 self-contained breathing apparatus.
