Case summary

This enforcement actions was filed in response to an anhydrous ammonia release which occurred on November 2, 2011. The release was reported to the SERC 11 minutes after it occurred however no corresponding NRC notification was found for this event. During the release, approximately 5,411 pounds of ammonia spilled/escaped into the ambient air. USEPA and Harvest Land entered into a Consent Agreement and Final Order (CAFO), with a civil penalty of $9,375.00 for the CERCLA violation. Respondent also agreed to complete the following two SEPs, as follows: 1. Purchase and provide to the Morgan Fire Department a pumper truck and 2. Purchase and provide to the Morton Fire Department a rescue grain. Respondent agreed to spend at least $32,758.00 for the Pumper Truck SEP, and Respondent agreed to spend at least $2,398.00 for the Rescue Grain Tube SEP.
