On September 25, 2014, Region 5 entered into a Consent Agreement and Final Order (CAFO) resolving claims against Pyramid Paving and Contracting Company. Pyramid Paving and Contracting Company owns and operates a hot mix asphalt facility located in Essexville, Michigan (the facility). On February 22, 2013, Region 5 issued a Notice and Finding of Violation (NOV/FOV) alleging that Pyramid Paving and Contracting Company violated Michigan SIP Rule 201 and the conditions contained within its Permit to Install No. 260-81B. On September 17, 2013, Pyramid and EPA agreed to the terms of an Administrative Consent Order (ACO). Pyramid resolved compliance issues by installing side curtains on the truck loading station and ducting the station to an existing baghouse; developing, submitting, and operating in accordance with a baghouse operation and maintenance plan; and improving record keeping practices. Under the terms of the CAFO, Pyramid has agreed to pay a civil penalty of $99,055.
