Case summary

EPA found that Jupiter Aluminum Corporation ? Coilcoating Division (Jupiter) was in violation of the NESHAP for Surface Coating of Metal Coil (Part 63 Subpart SSSS) and Title V of the Clean Air Act at their Fairland, Indiana facility. Specifically, Jupiter failed to maintain adequate temperature on either of the thermal oxidizers on site, and failed to calibrate the temperature monitoring equipment as required. EPA inspected the Jupiter facility on July 19, 2012. EPA issued a Finding of Violation (FOV) to Jupiter on December 20, 2012, alleging the above stated violations. A Section 113 Conference was held on February 4, 2013. EPA entered into an Administrative Consent Order with Jupiter which requires the facility to implement a new program for monitoring, calculating, and recording thermal oxidizer temperatures. A Consent and Final Order further requires Jupiter to pay a $140,394 civil penalty.
