Case summary

EPA filed a Consent Agreement and Final Order (CAFO) to resolve a Notice and Finding of Violation (NOV/FOV) issued September 27, 2012. The NOV/FOV alleged that Motor Castings Company failed to apply for a Wisconsin construction permit for a new calciner. EPA also alleged that Motor Castings failed to monitor stack emissions in violation of the Standards of Performance for Calciners and Dryers in Mineral Industries, at 40 C.F.R. Part 60, Subpart UUU, and failed to calibrate pressure drop gages needed to properly monitor the performance of emission controls in violation of the National Emissions Standards for Hazardous Air Pollutants (NESHAP) for Iron and Steel Foundries Area Sources at 40 C.F.R. Part 63, Subpart ZZZZZ. EPA did not pursue the permit violations, but pursued enforcement of the federal regulations. The CAFO requires Motor Castings to pay a $40,000 civil penalty. Motor Castings has corrected the violations and is now in compliance.
