By this referral, the US EPA requests that the US DOJ commence proceedings under Section 104 of CERCLA for the purpose of securing judicial orders in aid of access at the Gary Development Landfill Site, located in Gary, IN. Judicial orders in aid of access are necessary to premit access to further inspect and sample abandoned hazardous waste and to facilitate the performance of a remedial investigation and feasibility study (RI/FS) at the site by a group of settling parties pursuant to a CERCLA AOC. US EPA has been unable to obtain voluntary access from two of the current owners of the site, and the access agreement signed by a third owner is of questionable validity.
