Case summary

On September 30, 2013, U.S. EPA filed a Consent Agreement and Final Order (CAFO) against Pace Analytical Services, Inc. ( Pace Analytical ), to resolve alleged violations of the Resource Conservation and Recovery Act (RCRA), as amended, 42 U.S.C. §6901 et seq., by Pace Analytical, at its facility in Green Bay, Wisconsin. The allegations included: storage of hazardous waste without a license or interim status; failure to meet all the applicable conditions necessary to exempt it from the requirement to obtain a license; failure to make waste determinations; failure to label and close hazardous waste containers; failure to maintain complete land disposal restriction documentation and manifest content violations; failure to maintain a complete contingency plan; and failure to submit the contingency plan to the required authorities. Pace Analytical has agreed to pay a civil penalty of $60,133. The CAFO does not include any injunctive relief because of Pace Analytical's complying actions since the inspection and its response to the Notice of Violation.
