Case summary
During an EPCRA 311/312 compliance inspection conducted on 6/28/2012, it was discovered that the facility had lead-acid batteries on site which contained sulfuric acid and lead in quantities over the reporting thresholds for these two substances. The facility had not submitted Tier II forms or MSDSs to the appropriate organizations (SERC, LEPC and fire department) for these substances. The facility was late in submitting Tier II forms for calendar years 2008 thru 2011.
