Case summary
This enforcement action was filed in response to a diesel fuel spill which occurred on 1/26/2007. Approximately 4,600 gallons of diesel fuel were discharged onto the roof of the facility and 2,600 gallons of this amount were discharged into the facility's forebay which is connected to Lake Erie. Upon subsequent review of the facility's 2006 SPCC Plan, it was found to be deficient in areas related to providing appropriate containment and/or diversionary structures and equipment for preventing discharged oil from reaching navigable waters. The facility also failed to implement parts of their SPCC Plan related to personnel training, discharge prevention procedures, discharge response protocols and general facility operations.
