Case summary
On 3/1/2012 Vi-Chem Corporation disclosed violations to EPCRA 311/312 and CWA 311/SPCC. Violations included failure to submit Tier II forms (EPCRA 312) and MSDSs (EPCRA 311) for multiple chemicals to the SERC, LEPC and local fire department with jurisdiction over the facility for calendar yers 2007 through 2011. Vi-Chem also either under-reported or misreported quantities of multiple reportable chemicals on its Tier II forms for calendar years 2007 through 2010. Vi-Chem also failed to prepare an SPCC Plan as required by CWA 311(j). Vi-Chem stored petroleum products in quantities exceeding the threshold capacity requiring an SPCC Plan. Vi-Chem has met the conditions for a 100% reduction in gravity-based penalties pursuant to the Small Business Compliance Policy.
