Region 5 plans to file a Consent Agreement and Final Order (CAFO) concurrently with an Administrative Consent Order (ACO) to resolve an FOV issued March 26, 2013, to Spectro Alloys Corporation (Spectro), of Rosemount, Minnesota. EPA’s FOV alleged Spectro emitted PM in excess of limits contained in its Title V Permit and the National Emission Standards for Hazardous Air Pollutants (NESHAP) at 40 C.F.R. § 63.1505(b)(1), and failed to ensure its baghouse bags were in good working condition in accordance with the NESHAP at 40 C.F.R. §§ 63.6(e)(1)(i) during its January 8-9, 2013 performance test at the Hammermill baghouse. The ACO requires that Spectro submit an updated OM&M Plan incorporating additional baghouse inspections, calibrations, quality assurance measures, and a specific range of differential pressure standards within 60 days of the effective date of the ACO. The compliance provisions in the ACO also require that Spectro inspect baghouse leak detection systems and continue to record pressure drop across the Hammermill baghouse once per shift. The CAFO will require Spectro to pay a penalty of $52,588. Spectro is currently in compliance with the Clean Air Act.
