EPA v. MUNCIE CASTING CORPORATION

Case summary

EPA identified violations of New Source Performance Standards for Calciners and Dryers in Mineral Industries, 40 C.F.R. Part 60, Subpart UUU during an inspection on April 18, 2012. The administrative compliance order (ACO) required Muncie Casting Corporation to conduct PM and opacity testing at its thermal sand reclamation unit as required by NSPS Subpart UUU. Specifically, the ACO required Muncie Casting Corporation submit a protocol for performance testing within 30 days after the effective date of the ACO to EPA and IDEM, and within 90 days of EPA and IDEM’s approval, conduct the performance test. The compliance provisions in the ACO also require that in lieu of compliance with the emission monitoring provisions of Subpart UUU, Muncie Casting Corporation continue performing Method 22 daily visible emission readings and continue to record pressure drop across the baghouse associated with the thermal sand reclamation unit.
