Case summary

On June 22, 2012, EPA issued a Finding of Violation to Solutia, Inc. (Solutia), Trenton, Michigan for violations of regulations established in accordance with 40 C.F.R. Part 82, Subpart F. Specifically, Solutia failed to repair equipment that was leaking refrigerant at a rate that exceeded 35 percent of the total charges during a 12-month period within 30 days of discovery, or to develop a one-year retrofit or retirement plan for the leaking appliance within 30 days of a failed verification test, pursuant to 40 C.F.R. § 82.156. Additionally, Solutia failed to perform an initial verification test and follow up verification test after making a repair. EPA discovered these violations through a series of self-disclosure letters sent to EPA. EPA is issuing a Consent Agreement and Final Order (CAFO). he CAFO requires Solutia, Inc. to pay a penalty of $55,391 and do a Supplemental Environmental Project (SEP). On June 22, 2012, EPA sent a Finding of Violation to Solutia, Inc. for not complying with the above referenced regulations. Solutia has resolved these violations and has agreed to do a SEP. The SEP requires the replacement of chiller AC-R4 that currently uses an ozone depleting substance with the installation of a compressor chiller utilizing a non-ozone depleting substance. The retrofit of AC-R4 will be completed within 12 months of the effective date of the CAFO. For Injunctive Relief: Solutia plans to replace the current 12 ton, 100 horse power (hp) Mycom Mypro V evaporative water cooled chiller supplied with -28°F d-limonene, known as AC-R5 with a non-ODS charged chiller in 2014. AC-R5 was an emission unit alleged in the violation notice issued by EPA.
