Case summary

Shelbyville Plating & Polishing (SP&P) owns and operates a metal electroplating and polishing facility at 1010 St. Joseph Street Shelbyville, Indiana. The U.S. Environmental Protection Agency, Region 5, will issued a Notice and Finding of Violation under the Clean Air Act to SP&P for alleged violations of Section 112 of the Act, 42 U.S.C. ? 7412, and the implementing regulations at 40 C.F.R. Part 63, Subpart WWWWWW, the National Emission Standards for Hazardous Air Pollutants: Area Source Standards for Plating and Polishing Operations (NESHAPs Subpart WWWWWW). In violating NESHAPs Subpart WWWWWW, SP&P had also violated the Indiana State Implementation Plant and SP&P?s Minor Source Operating Permit. Specifically, EPA alleges that SP&P failed to properly implement pollution control on their nickel electroplating tank required by NESHAPs Subpart WWWWWW, as well as failing to perform notification and reporting required by this subpart. EPA discovered these violations while inspecting the facility on July 18, 2012, and after reviewing data acquired from SP&P via an information request. SP&P subsequently completed notification and reporting compliant with NESHAPs Subpart WWWWWW. SP&P also provided information indicating that an appropriate pollution control measure had been taken to control nickel emissions from their nickel electroplating tank. This measure was the addition of fume suppressant/wetting agent that lowers the surface tension of the tank liquid. Based on these compliance efforts by SP&P, including the lack of environmental harm, EPA and SP&P entered into an Administrative Compliance Order without assessment of a penalty.
