EPA v. THERMAFIBER INCORPORATED
Case summary
In September 2011, EPA issued a Notice of Violation (NOV) to Thermafiber, Inc. of Wabash, Indiana for violations of the Indiana State Implementation Plan. Specifically, in January 2009 Thermafiber began using a fuel substitute at their mineral wool manufacturing facility. This fuel change constituted a change in method of operation and was a major modification that triggered requirements of the Prevention of Significant Deterioration (PSD) program. Thermafiber did not apply for or receive a PSD permit for the change in method of operations. Since the issuance of the NOV, Thermafiber has ceased using the alternate fuel source, and has installed additional air pollution control equipment at the facility. Under this CAFO, Thermafiber will agree to conduct additional emissions testing, will agree to continuously operate the air pollution control equipment, and will pay a civil penalty of $93,000.
