Case summary

On [date] , 2013, Region 5 entered into a Consent Agreement and Final Order (CAFO) resolving claims against John Deere Horicon Works of Deere & Company. John Deere Horicon Works owns and operates a riding lawn and utility vehicle manufacturing facility located in Horicon, Wisconsin (the facility). The facility includes five boilers, 30 four-stroke engine testing cells, and 24 run-in stations, which generate emissions of carbon monoxide (CO). In February of 2012, John Deere Horicon Works disclosed an exceedance of its 25 ton per year CO emission limit for calendar year 2011. On August 23, 2012, Region 5 issued a Notice of Violation (NOV) alleging that John Deere Horicon Works violated conditions of its permit, the Wisconsin state implementation plan, and the Clean Air Act. After discovering the CO exceedence, the facility took steps to return to compliance, including applying for a new permit with operational limits and fuel use limits, performing new air emissions modeling, raising boiler stacks, and installing a catalytic oxidation unit to control carbon monoxide, at a cost of approximately $1.9 million. In addition, in settlement with the United States, John Deere Horicon Works of Deere & Company will pay a $50,000 civil penalty.
