Case summary
PPG owns and operates a hazardous waste incinerator in Circleville, Ohio. PPG exceeded the HWC MACT dioxin/furan limit during its March, May, and August 2012 performance tests. Pursuant to the HWC MACT, the owner or operator of an existing hazardous waste incinerator must not discharge or cause combustion gases to be emitted into the atmosphere that contain dioxin/furan in excess of 0.20 nanogram toxic equivalent per dry standard cubic meter, corrected to 7 percent oxygen (ng TEQ/dscm @ 7% O2). The average dioxin/furan emission concentration during the three tests was 0.62 ng TEQ/dscm @ 7% O2. Since September 1, 2012, PPG has ceased burning hazardous waste at this facility. Under the terms of the CAFO, PPG has agreed to pay a civil penalty of $155,793. The civil penalty was calculated by using EPAs Clean Air Act Stationary Source Civil Penalty Policy. Under the policy, the Region calculated a penalty amount of $155,793.
