Case summary
The Jacksonville Developmental Center (JDC) is owned and operated by the State of Illinois though the Illinois Department of Human Services (DHS). The facility operates four coal-fired boilers which provide both heat and electricity to the facility. The State expects to cease operating the facility in its current use as a hospital/care facility in late 2012. The Regional enforcement team has resolved the violations administratively through a 113(a) order by consent signed on October 15, 2012. The Region 5 enforcement team held a 113 conference with the facility and DHS in May 2011, and has subsequently met with them to discuss boiler repairs and compliance. At this time, it appears that JDC is operating the boilers in compliance with its Title V permit and the Illinois SIP. On October 16, the Facility informed EPA that on or prior to June 30, 2013, all four boilers will be retired and rendered inoperable. In addition, the existing stockpile will provide a fuel source for the boilers for approximately five weeks, ending on or approximately on November 16, 2012. The Administrative Consent Order requires the Facility to submit a plan by January 1, 2013 for each unit detailing the plan for retirement and to being retiring units according to an agreed upon schedule with EPA. In addition, the Facility must surrender all Clean Air Act permits to the State under the shutdown policy.
