EPA v. CRAB ORCHARD WILDLIFE REFUGE/SANGAMO ELECTRIC DUMP (Site 36) - CONSENT DECREE (CERCLA)

Case summary

This Consent Decree is pursuant to CERCLA Section 107 cost recovery and to closeout further efforts to recover any unrecovered response costs at Site 36. The proposed settlement obtains approximately 98% of the United States Environmental Protection Agency's response costs incurred investigating, and overseeing the Department of Interior's (DOI) cleanup of the Site 36 of the Crab Orchard National Wildlife Refuge National Priority List (NPL) Site (Crab Orchard Site) Miscellaneous Areas Operable Unit 4 (OU 4). Under-the terms of the proposed cost recovery settlement, Settling Defendants and Settling Federal Agencies will pay EPA $618,524 which represents recovery of 98% of EPA response costs (without interest), incurred at Site 36 through June 30, 2012. After entry of this settlement, there will remain approximately $6,719 in unrecovered EPA response costs. No significant future EPA response costs are expected since the DOI completed the remedial action at Site 36 in 2006. As the owner of Site 36, DOI will conduct post-remediation groundwater monitoring. EPA's Site 36 groundwater monitoring oversight costs are estimated to be less than ten EPA personnel hours annually. The small amount of remaining unrecovered response costs and lack of known liable parties do not justify further enforcement efforts unrecovered EPA response costs.
