Case summary
On September 28, 2012 EAP filed a Complaint and Compliance Order (Complaint) against Wismarq Corporation. The complaint alleges that Wismarq Corporation was operating a hazardous waste storage facility without a permit by failing to: 1) mark 15 containers with the start date of the accumulation of hazardous waste; 2) provide initial or annual training and failing to maintain training records; 3) conduct and maintain weekly inspection records; 4) submit Hazardous Waste Annual Reports for 2007, 2008, 2009 and 2010; 5) make waste determinations of its chromium waste; and 6) keep records of the chromium waste analysis results. EPA has assessed a civil penalty of $128,737 for the violation alleged in the complaint.
