Case summary

September 20, 2012, Region 5 filed a Consent Agreement and Final Order (CAFO) with Cleveland Steel Container Corporation (CSCC) concluding the proceeding against the Respondent for RCRA violations. CSCC manufactures stainless steel pail containers in sizes ranging from 2.5 to 7.5 gallons. EPA's allegations were based on information and documents provided by CSCC during an inspection on March 29, 2011, and pre-filing settlement discussions, as well as CSCC's submission of documents in response to a Notice of Violation and to a Pre-Filing Notice and Opportunity to Confer Letter. In summary, CSCC operated without a permit by failing to properly label several drums of hazardous waste, failed to update its contingency plan, failed to provide annual hazardous waste training to its staff, and failed to provide a complete annual hazardous waste report to the Illinois Environmental Protection Agency in 2010. For the purposes of settlement, a penalty of $22,176 was agreed upon.
